In reality, Yes without concern just that from now on, Intel considers the X.M.P profile (that you enable to set it to the speed displayed in the UEFI/BIOS) on RAMs that have frequencies above 2400 MHz (the most basic of RAM speeds) as overclocking.
And therefore potentially not supported by the warranty if you set it to the indicated frequency.
